  • Your children will stay in foster care while a court decides who will become their permanent guardian, a process which could take weeks or even months
  • The Illinois Intestacy Statute will determine how much of your estate goes to your spouse and how much goes to your children
  • Your children will get their inheritance money at the age of 18, regardless of how well they are able to manage their finances
  • If your spouse remarries, the money your spouse inherits may be left to your spouse's new partner or his/her children, and not your children

Many people try to avoid the default estate plan by creating a Will. It is true that everyone should have a Will. But a Will can't avoid all of the provisions of the default estate plan listed above. In addition, a Will has other limitations and problems:

  • If you become incapacitated, your children will stay in foster care while a court decides who will become their temporary guardian even if your Will identifies a permanent guardian (Why? Because a Will tells the court what to do when you die)
  • Your Last Will and Testament and private financial information will be made public through the court process called "probate"
